Vehicle owners must comply with these Terms and Conditions when entering and using the

Electric Vehicle (EV) Charging Facilities. In the event of any violation of these Terms and

Conditions by a vehicle owner, the Company , the Management Office, and the Charging Operator reserve the right to request the said owner and vehicle to leave the Area.

1. Legal Basis and Compliance Statement

1.1 Electricity Ordinance Compliance:

The design, installation, inspection, and maintenance of all charging facilities (hereinafter referred to as "Charging Devices") within the Area strictly comply with the requirements of the Electricity Ordinance (Chapter 406 of the Laws of Hong Kong), its subsidiary legislation the Electricity

(Wiring) Regulations, and the latest edition of the Code of Practice for the Electricity (Wiring)

Regulations issued by the Electrical and Mechanical Services Department (EMSD).

1.2 Statutory Certificates:

All charging circuits must undergo statutory inspection by a "Registered Electrical Contractor"

(REC) and a "Registered Electrical Worker" (REW), and must possess a valid Work Completion

Certificate (Form WR1) or Periodic Test Certificate (Form WR2). The Management Office

reserves the right to suspend the electricity supply at any time for government spot checks or statutory annual inspections.

1.3 Legal Definition of Electricity Resale:

The charging fees collected by the Area are legally defined as "Charging Service Fees" rather than the direct "Resale of Electricity," which fully complies with the Scheme of Control Agreements of the two power companies in Hong Kong (CLP / HK Electric).

2. User Qualifications and Vehicle Access Restrictions

2.1 Eligible Vehicle Types:

Charging bays are exclusively for the use of pure electric vehicles and plug-in hybrid electric

vehicles that hold a valid license issued by the Transport Department, have paid sufficient license

fees, and meet the government's definition. Non-electric vehicles are strictly prohibited from

entering or parking in the charging bays.

2.2 Charging Interface Standards:

The charging socket of the vehicle must be of original factory configuration and fully comply with internationally and locally recognized safety standards in Hong Kong.

2.3 Prohibition of Modifications and Third-Party Accessories:

The use of any adapters not approved by the government or the original manufacturer is strictly

prohibited.

The use of any extension cords or portable charging power strips is strictly prohibited.

The use of charging cables that have been self-modified, damaged, have exposed copper wires, or

show signs of fire burn/water immersion is strictly prohibited.

3. Standard Operating Procedures and Safety Guidelines

3.1 Initiation Procedure:

Users must strictly follow the steps indicated on the charging pile to perform the initiation and

termination procedures.

3.2 Handling Abnormalities:

If smoke, unusual odor, sparks, or abnormally high temperature is detected from the vehicle body

or the charging pile during the charging process, the user shall, provided that their own safety is

secured, immediately press the red "Emergency Stop Button" next to the charging pile or on the

wall, and immediately notify the Security Office or call 999.

4. Fire Safety and Dangerous Goods Control

4.1 Compliance with Fire Services Department Guidelines:

The EV charging area of the Area has been equipped with corresponding fire protection systems in accordance with the guidelines of the Hong Kong Fire Services Department.

4.2 Prohibition of Flammable Substances:

Inside the charging vehicle and within a 5-meter radius around the charging bay, it is strictly

prohibited to store any dangerous goods listed under the Dangerous Goods Ordinance (Chapter 295 of the Laws of Hong Kong) (such as spare petrol, thinner, solvents, large quantities of lithium batteries, etc.).

4.3 Strict Prohibition of Naked Flames:

Smoking, igniting fires, or performing any maintenance work that generates sparks is strictly

prohibited in the charging bays at all times.

5. Bay Resource Management, Overtime, and Anti-Occupation Mechanism

5.1 Principle of Exclusive Use:

The statutory/contractual purpose of EV bays is as a "Parking Area for Vehicles Undergoing

Charging". "Parking" does not equal "Charging".

5.2 Definition of Charging Completion:** When the charging pile system displays "Charging

Completed," "Power Supply Stopped," or when the vehicle's state of charge has reached the upper

limit set by the user in the App (such as 80% or 100%), the charging process shall be deemed

finished.

5.3 Grace Period: A grace period of 15 minutes will be granted by the system starting from the

time charging finishes for the user to remove the vehicle.

5.4 Overtime Surcharges:

If the vehicle continues to occupy the charging bay beyond the grace period, the system will

automatically begin calculating the statutory overtime occupancy fee.

Fee Standard: HK$300.00 per hour (any fraction of a minute will be charged as one full minute). This fee has no upper limit and is calculated independently and accumulated on top of the regular

fees for using the facilities.

5.5 Handling of Occupation by Non-EVs / Non-Charging Status:

Any fuel-powered vehicle occupying a charging bay, or any electric vehicle parked there without being plugged in for charging, constitutes a violation of this code.

6. Smart Power Load Management

6.1 Dynamic Power Distribution Statement: A smart power load management system is adopted in this Area. When multiple electric vehicles are charging simultaneously, the system will

automatically allocate, limit, or reduce the output power of individual charging piles (for example, from 22kW down to 7kW) to prevent the main power switch from overloading.

6.2 No Guarantee on Charging Time:

Users accept and agree that the charging speed is subject to the overall power consumption, the

number of vehicles charging simultaneously, and the vehicle's own battery management system.

The Management Office does not guarantee that the vehicle can be fully charged within a specific

time, nor will any refunds or compensation be made due to reduced charging speed.

7. Limitation of Liability and Indemnity Clauses

7.1 Power Supply Disclaimer:

In the event that power supply network issues of the power company (including voltage instability, voltage dips, power outages), problems in other power supply systems, sudden failures of the

electrical system, or emergency power outages implemented in accordance with government

regulations result in:

1. Interruption or failure to initiate charging;

2. Damage to the vehicle's Electronic Control Unit (ECU) or Battery Management System

(BMS);

the Company, the Management Office, and the Charging Operator shall not bear any direct or

indirect legal liability for compensation.

7.2 Third-Party Acts Disclaimer:

During the period when the vehicle is parked in the charging area, if it suffers from collision by

third-party vehicles, malicious vandalism, theft, or losses caused by natural disasters (such as

typhoons, flooding, lightning strikes), the user must contact their own motor insurance company.

The Company, the Management Office, and the Charging Operator shall accept no responsibility.

7.3 User Negligence Liability for Compensation:

If a user engages in the following behaviors:

1. Improper operation of the charging pile (such as forceful pulling, impacting, or failing to

return the charging nozzle to its position);

2. Use of non-compliant adapter cables or modification of the vehicle's charging system;

3. Violation of fire safety guidelines;

and thereby causes damage to the charging pile, burnout of the power supply system, or triggers a fire resulting in property loss to the Area and third-party casualties, the said owner/driver must bear full legal liability and compensate the Management Office and affected third parties in full for all replacement, repair, and business losses.

7.4 To avoid any misunderstanding, the Company, the Management Office, and the EV charging operator will under no circumstances issue any form of refund to any user or third party.

8. Amendments to Terms and Final Decision Right

8.1 Right to Amend Terms:

The Company, the Management Office, and the Charging Operator reserve the right to modify this code at any time in response to changes in Hong Kong laws or new guidelines from the Fire

Services Department or the Electrical and Mechanical Services Department. The modified terms

shall take effect immediately upon announcement on the notice boards or the mobile application.

8.2 Right of Final Decision:

In the event of any dispute regarding the interpretation of the provisions of this code or the grace

period for the calculation of overtime fees, the Company, the Management Office, and the Charging Operator possess the final and absolute right of decision, and users shall raise no objection.

9. Governing Law and Jurisdiction

9.1 The formation, validity, interpretation, performance, and settlement of disputes of this

Agreement shall be governed by the laws of the Hong Kong Special Administrative Region.
